Digital Services Termination Guidelines

Library & Archives NT may terminate your access to digital services account if you use the services to infringe copyright.

8. Digital Services Termination Guidelines

 

8.1  Library & Archives NT (LANT) will terminate your account or access to a particular digital service if:

 

i. LANT becomes aware that you have been found by an Australian court to have infringed copyright on at least three occasions using the institution’s service by any means. LANT may issue a warning notice or suspension following the first and second occasion before a permanent termination of the your account is enacted; or

ii. LANT becomes aware that you have made a written admission that you have infringed copyright on at least three occasions using the LANT’s digital services. LANT may issue a warning notice or suspension following the first and second occasion before a permanent termination of the your account is enacted; or

iii. LANT takes down material uploaded by you on its digital services at least three times within a twelve month period from the first takedown as a result of:

      a) A credible takedown notice received from a copyright owner/licensee alleging that this material infringes copyright; or

      b) LANT itself becoming aware that the material is likely to infringe copyright.

Note: An allegation of copyright infringement, either by the copyright owner/licensee or by the institution, will not count towards this provision if you successfully challenge the claim.

 

8.2. LANT will not terminate your account or access to a particular digital service if your account / service was used by a person other than you, and without your knowledge or consent.

 

8.3. LANT will reinstate your account or access to a particular digital service if you successfully appeal the termination on review which entitles you to have your account reinstated by the institution.
